Legislative Update

House. The House will add another member to its ranks this evening when Democrat LaMonica McIver is sworn in as the new Representative from New Jersey’s 10th district. McIver is taking the seat of the late Rep. Donald Payne Jr. (D) and is expected to win a full term in the November elections. The House will now have 220 Republicans, 212 Democrats, and three vacancies.

The most pressing issue on this week’s agenda is a continuing resolution (CR) that will fund government programs at their current levels through Dec. 20. The measure is expected to be approved by the House on Wednesday, but it is unclear whether it will pass under a rule, requiring a majority vote, or under suspension, requiring a two-thirds vote. The uncertainty stems from internal Republican politics, both in the Rules Committee and on the House floor, around support for a rule governing floor debate. If Republicans cannot muster enough votes from within their own ranks for considering the bill under a rule, Speaker Mike Johnson will have to pivot to a suspension vote.

Senate. Once the House approves the CR, the Senate will take it up, with the hope of clearing it by Friday, when lawmakers plan to leave D.C. until after the November elections. While waiting for House action, the Senate will continue to consider nominations.
